General terms and conditions of Tender the brand, valid from 17-05-2024

1. General

1.1 These general terms and conditions apply to all orders placed with Tender the brand.

1.2 By placing an order, you agree to the terms of delivery and/or payment, the privacy policy, the shipping and return policy, and the warranty policy.

1.3 Tender the brand reserves the right to change its delivery and/or payment terms and the return, shipping, and warranty policies.

1.4 Tender the brand guarantees that the delivered product complies with the agreement and meets the specifications stated in the offer.

1.5 Unless otherwise agreed in writing, general or specific terms and conditions of third parties are not recognized by Tender the brand.

2. Payment, Shipping and Delivery (see also our Shipping and Returns Policy)

2.1 Payment is made via IDEAL.

2.2 Shipping of an order will take place within 1-5 days after full payment of the order.

2.3 Tender the brand uses the following shipping methods:

  • Clothing via DHL
  • Accessories via POSTNL & DHL

2.4 Products will be delivered while stocks last.

2.5 In accordance with the rules regarding distance selling, the customer will receive a notification from Tender the Brand if their order is delayed. In that case, the customer has the right to cancel the order free of charge.

2.6 Tender the brand's delivery obligation is fulfilled once the order has been presented to the customer. For home delivery, the carrier's report, including the refusal of acceptance, serves as full proof of the offer to deliver.

2.7 All shipping and delivery times stated on the website are indicative. Therefore, no rights can be derived from these times.

2.8 If the packaging of an order is opened or damaged upon delivery, the customer must have the carrier make a note of this before accepting the product. If the customer fails to do so, Tender the brand is not liable for any damage or defects to the order.

3. Prices

3.1 All prices listed on the website are subject to printing and typographical errors. No liability is accepted for the consequences of printing and typographical errors.

3.2 All prices stated on the site are in euros and include 21% VAT.

3.3 Prices will not be increased during the offer period unless legal measures make this necessary or if the manufacturer implements interim price increases.

4. Right of withdrawal and returns (see also our shipping and returns policy

4.1 Under the statutory provisions, the customer has a 14-day right of withdrawal. At Tender the Brand, the customer has a 14-day cooling-off period from the date of delivery of the order. 

4.2 The right of withdrawal lapses in the following circumstances:

4.2.1 If the product has been used and/or worn

4.2.2 For hygienic reasons, including underwear and/or swimwear

4.2.3 If a product is custom-made especially for the customer

4.3 Returns must be made within 14 days of delivery of the order, using the returns procedure described in the returns policy. Return shipping costs are the customer's responsibility.

5. Warranty

5.1 Tender the brand guarantees that the products comply with the agreement, the specifications stated in the offer, the reasonable requirements of soundness and/or usability, and the legal provisions and/or government regulations in force on the date the agreement is concluded.

5.2 The customer is obligated to inspect the delivered products upon receipt. If the delivered products appear to be incorrect, defective, or incomplete, the customer must notify Tender the Brand in writing within 24 hours of delivery, using the following email address: vragen_tenderthebrand@hotmail.com

5.3 In the event of use after defects have been discovered, damage(s) occurring after defects have been discovered, encumberment and/or resale after defects have been discovered, the right to make a complaint and return shall be completely void.

5.4 If Tender the brand finds the customer's complaint to be justified, Tender the brand will initially replace the delivered products free of charge. If replacement is not possible, a refund will be provided or another written arrangement will be made that is suitable for both the customer and Tender the brand.

5.5 This warranty does not apply if:

  • the customer is in default towards Tender the brand.
  • the customer has repaired the delivered products themselves or has had them repaired/edited by third parties.
  • the delivered products have been exposed to abnormal conditions, have been treated carelessly or have been treated contrary to the instructions of Tender the brand and/or the instructions for use on the packaging.

5.6 Tender the brand is not liable for damage caused intentionally

5.7 The following is not covered by the warranty

  • Pilling on clothing is caused by friction with other materials. You can prevent pilling/linting by washing your garment inside out, following the care label instructions, and using a laundry bag if necessary.

    You can remove pills/lint by using a razor, lint roller or lint brush

  • Sequins, studs, and glitter on clothing. You can prevent sequins, studs, or glitter from falling off by washing the item inside out in a laundry bag.
  • On PreLoved blazers. Because the blazers and sleeves are made from secondhand items, no warranty can be given on these components. However, a warranty is given on the seam where the sleeve is sewn to the blazer. Tender the brand carefully selects its secondhand clothing and inspects it for cleanliness and quality, but cannot be held liable for any defects in the item that are not visible during production, shipping, and delivery.

6. Images and specifications

6.1 Images (photos) and information regarding dimensions, colors, images of labels, etc. shown on the Tender the Brand website are approximate and indicative only, and cannot give rise to compensation or termination of the agreement. We strive to make the images as close to the original as possible, but they may vary slightly due to lighting, background, etc.

6.2 All images shown on the site were created by Tender the brand. They may not be shared with third parties or used for other (commercial) purposes without permission.

7. Liability

7.1 Tender the Brand is not liable for damage to third parties, vehicles, or other objects caused by incorrect use of the products. Before use, read the instructions on the packaging and/or consult our website.
